I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

No. The only issue I had was that they don't let you book well in advance, which makes it difficult to plan travel. Also, I did not realize until the last minute that you need to submit your documents 4 days in advance before the interview. Luckily one of my friends told me about it and I was able to request my dad to submit the documents in time. Not sure what would have happened if I did not submit the documents upfront...may be, they might have still allowed me in.
3. I have all the documentation in place including pay stubs in the last 8 years.
Good. I have been working for 8 years as well and took the paystubs for just this year(2010) and tax returns for past 3 years. But, they did not ask anything as I was renewing for the same company for the same job. They just asked what I do for the company.
4. Is it preferable to get stamping done in Canada than in Hyderabad,
I prefer Hyd as that is where my parents live and I don't have to waste travel fares, visa fees (for canada visa), hotel, vacation etc by going to canada. I just got it done when visiting my parents. If you live close to Canada or have special travel needs, then may be Canada should be considered.
5. How many days does it take to get the passport back.
7 days total I think, including weekend.

It is not just enough for you to have the qualifications for EB2. The job requirements also should have that requirements. So in the PERM application - the job requirements has to be specified. I think the lawyer messed up the PERM process

Do we get a notice to get biometrics done when you apply for EAD renewal?
My wife and I have a EAD renewal RD of June 23, 2008 at NSC. We have not gotten any LUD after that. Anybody knows how long it takes to get the EAD?

Experience should be AFTER you get your degree. Also, your experience with current employer cannot be counted unless the new opening is substantially different than your current position.

This visa has initially been sponsored by a company, so I can only work for this company
A lawyer told me that I could self-sponsor another o1 and then be able to work for as much company I want. I have an agent but he is not able to guarantee full time employment.
So I am wondering if I should do that or not.. What are the exact salary requirements for a self-sponsored o1?
I got a good folder, awards, recommendations and publications.

To the best of my knowledge, I am not aware of any "self sponsored O visa". O visa is unfortunately owned by a specific employer and you are only authorized to work for that employer.
What you could consider is to file an EB1A greencard and file it concurrently with I485, EAD and AP and then you can work on EAD for as many employers as you wish. However, your case (awards, recommendations, publications, citations etc) should be a "good case" for EB1A (and generally if you are good for O visa, it is quite likely that you are good for EB1A, but this is not an absoulte rule). Go with a good attorney with experience in EB1 cases.

I think you get AP in out of Country when you are applying.
I'm in same boat as you couple of months of back and i canceled my trip as I got advise from Expert (Attorney) that AP's approved when out of country are not valid.

Whereas appeal to I-140 is 21 month delay so I assume that I-140 will take its own sweet time. But What about appeal to I-485 which is current. Am I going to get any response on I-485 appeal process soon?? Anyway thanks for sharing your experience with me.
When 140 is denied, then 485 is also denied. Appeal going to AAO is common thing. Will sit there forever. Its takes approximately 12-20 months to get a reply.
Mine is already crossed 12 months now.

All,
I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.
I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.
Also will her getting approved without I-94 impact her pending AOS in anyway

Does anybody have idea or experience how long it takes for USCIS to make desicion about I-485 expedition (pending for 2.8 years now)?
My hospital sent expedition request to TSC about 3 months ago, there is no replay yet.
I'll appreciate any advice/information.

The United States Immigration and Customs Enforcement (ICE) recently updated their list of Student and Exchange Visitor Program (SEVP) approved schools (http://www.ice.gov/doclib/sevis/pdf/ApprovedSchools.pdf). The schools listed have all been certified to participate in the program.
The program allows foreign students interested in obtaining an education in the United States to complete a visa petition, pay the required fee, and attend a U.S. College or University.
Interested Foreign students: There is a process in obtaining a student visa, but it is not a difficult one. The student must first obtain Form I-20 from the U.S. College or University from which he/she intends to enroll, pay the required visa fee (Form I-901) and contact a local U.S. Consulate/Embassy to schedule an interview. Interested Schools: There is a separate process to obtain F & M Certification. Authorized school officials must obtain and complete Form I-17. EB-3 ROW current PD is March 2003, his PD is 2006, so he is not current.

i submitted my 485 one month ago but still haven't got receipt. I just got a new job offer from a big company, which i really dont want to reject. if i transfer my h1b now, will be 485 get rejected immediately? or my h1b transfer will be rejected? thanks for your advice!
