    one thing I found with my IXUS v3 is that the pre-flash sometimes fools you into thinking the shots done. I have not had a lot of success with P&S and moving indoor targets. Where this is an issue, I revert to some thumpers.
    Manual mode might be the only way........

    I had applied for the extension of my parents in laws' stay online (I -539 form thro� USCIS E-FILE). Throughout the entire process of the application, I was not asked to turn in any documents. After submitting the form, I had called the USCIS to find out the list of documents that I needed to send. I was told then that during the processing of the application, if the USCIS needed any supporting documents, they will ask for it. I did not get any notification regarding the same in the last two months since the application was filed. However, I got a letter denying the extension. The reason stated was that I had not provided any supporting documents (that their stay was temporary, that they have enough funds, that they have reason to return back to India etc.). Is there any step that I could take to reverse this decision? I have all the supporting docs ready, and can send it to them immediately. I didn't send them earlier because I was specifically asked to wait for further instructions regarding the same. Can they change their decision if I provided all the documents? Any kind of help from anyone who has gone thru a similar situation or has had any such experience would be highly appreciated.

    Following is the situation:

    My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
    Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
    Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

    Falling short of 10 weeks to get the 365 days rule

    Options that I learnt for me getting 7th yr extension and staying in the country:

    Option1:
    Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Convert from H4 to H1 and start working.

    Option 2:

    Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
    File for 7th year extension based on the 365 days rule
    Stamping in canada to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)

    Option 3:

    Go back to India for 3 months wait till June 20th,
    File for 7th year extension based on the 365 days rule
    Stamping in India to return to USA.
    (I am hoping 7th year extension can be done while I am outside the country)


    Option 4:

    Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

    Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

    From what I know, it is not mandatory to file AC-21 but if you think your previous employer who filed for your I-140 can create problems for you, it's safe to file AC-21. Although, your previous employer can not withdraw your I-140 by law, some employees attempt to withdraw/cancel I-140. Sometimes, USCIS behaves in an un-expected manner and they might issues a NOID on your 485. If that happens, you will have to appoint an attorney who fights for you to repeal USCIS decision. You will win in the end, but you will go through some unwanted stress and will loose some money to the attorneys. In such cases, if you have filed for AC-21, it acts as another strong point to your fight against a erroneous decision from UCSIS.

    Thanks for the reply - that helps.

    Another question I had was about LUDs. I did my FP on Oct-29-07 on which date I also noticed an updated LUD (from Sep-25 to OCT-29).

    However, on Oct-31, I noticed that the LUD was updated yet again to OCT-30.

    Any idea what this could mean?

    My CP interview at Montreal in September 2008 (EB2 � India), I have few questions before interview.

    1. Do I have to get Affidavit of support or income come Tax Return from my sponsor company?
    2. Do I have to file Affidavit of support for spouse and children
    3. As my passport is going to expired I need to get new, Do I have to inform NVC/ consulate before Interview?

    Hello,

    After getting Employment based Green Card in EB3 or EB2 category:

    1. When is the LATEST you should start working for sponsoring employer ?
    (e.g. If card received on 3rd of the month, do you HAVE TO start same month or can wait for a month or so ?)

    2. If salary, after GC, is lesser than mentioned during Labor stage, what problems will it cause for:
    - GC renewal ?
    - US citizenship ?
    - OTHER problems (GC Cancelation, Deportation...)


    3. What if, after GC, sponsoring employer gives termination letter with:

    What happens if there is any future foreign travel planned and COS decision does not come in time. Will she have to wait to home country till decision is heard and then go for H4 stamping or she can anyways go for H4 stamping even if COS decision is pending?

    Hello Gurus,

    My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.

    I filed my I 485 in June 2007 and got EAD and AP

    1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.

    And what is 'H1 pending for 240 days rule'.

    Your answer is very much appriciated.

    Until you get any decision on your H1 extension, you are still considered on H1.
