She can stay as long as she wants, but it is finally up to the port of entry officer to decide to let her in or not depending on reason for staying outside (while 485 is pending) is valid or not. After all AP is supposed to be used only for emergency situations.
Can wife stay in India for more than 6 months while 485 is pending?
What she have now is an approved AP till 2009 december.
thanks

I would transfer to a visitor visa and then identify which university and course I want to join. Once I have all the things lined up I would hire a good attorney and file for a new F1.
Good luck.
hie,
i was on opt and my opt ended jan 24th 2009. i had applied to a masters program for spring 09. my old school ( where i did my bachelors) transfered my sevis information to my new school( where i was to start masters). however i decided to discontinue with my new school's masters program. i did not registered for classes. i told them that i would no longer want to pursue that particular masters anymore. i now want to join another institute for a short time. they require my sevis information in order to make an i20 for me. my new school( where i had applied for masters) says that they do not have an i20 for me since i cancelled my program. whichever institute i transfer to for future studies would require a copy of a current i20 from me for admissions.
now where does this situation leave me? am i out of status as of now? will i be able to transfer to any university/institute for my future studies?
Good luck.

Sorry I am not going to be help, but I would be interested in knowing when you find, why that was so.. I am one of the unlucky few whu missed the July 2007 filing bonanza by 1 day, based on when my labor was filed.. so if there is an alternate way to assign PD.. I can still continue crying....

There is no issue if your wife is the derivative applicant and gets her EAD through you. You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.
THello Everyone,
We are currently evaluating our options of starting a business on EAD, which should be coming within 3 months of filing of I485 in July. Does anyone know if I or my wife can start a business on EAD, are there any issues with it?
Thanks

Background OF Myself
----------------------
a) Worked for Company A from 2003 to 2008.
b) Company A applied I-140 and approved April 2006. AOS 485 filed on July 2007. Got EAD but never used it
c)September 2008 I have Joined employer B by transferring H1B (Valid until Aug 2010).
d) Employer A revoked 140 which triggered 485 denial in October 2008.
e)Applied MTR and it was approved in NOVEMBER 2008 and 485 reopened.
f)Applied AP & EAD renewal ,got a EAD card September 2010
g) Since EAD extension got delayed I have applied H1-B Renewal August 1st week of 2010 and got a RFE now asking for proof how beneficiary qualify to extend beyond six years?
Question
I think the I140 revoked and 485 denial back in 2008 triggered the RFE. (Though MTR approved and 485 is pending)
1)I have EAD approved and its valid until 2012 September .Is it possible can we withdraw HI-B Petition application when they request RFE?
2)Can I have any chance of explain USCIS, by this rule below?
USCIS has also specifically stated that if an approved I-140 is withdrawn after an I-485 has been pending for more than 180 days, the I-140 remains valid for purposes of AC21 106(c) portabilty:
"If the Form I-140 has been approved and the Form I-485 has been filed and remained unadjudicated for 180 days or more (as measured from the form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation." AFM Sec. 20.2(c)

I was wondering if anyone has any info on the job
market for international students in NY. I will be graduating
in Dec and will be on the job market soon.
Some of my friends say that there are jobs to be had but
not many are keen on sponsoring H1, even non-tarp firms.
Can anyone confirm/refute this?
market is tough but dont give up & just sit back though - for what its worth look aggressively & hopefully you have opt for 1+year available so they get a chance to look at you

On Thursday, May 14, 2009, Senator Diane Feinstein introduced a bill, nicknamed the “AgJobs Bill,” that seeks to grant amnesty for up to 1.35 million farm workers working in the country illegally, primarily in California. Feinstein and other legislators proposed the AgJobs Bill numerous times over the last decade but were met with fierce opposition. However, supporters of the bill – including the United Farm Workers of America and other worker advocates – are now hoping the legislation will become a legal reality under the Obama administration.
Generally, the AgJobs Bill would allow foreign farm workers who have been working illegally in the United States for at least two years to earn a path toward becoming legal permanent residents. Workers' family members would also be eligible for legal permanent residency, which could bring the number of legalized farm workers to approximately two million people. The bill would also focus on overhauling a program that aims to recruit foreign workers for seasonal jobs on American farms, where profitable construction jobs have tended to lure workers away.

EAD has nothing to do with your status. But yes, your status is OK as long as you have a pending 485 application.
Yes. You can use your EAD and work for any company.
No issues even if you are not working for some time.
You are authorized to work for any company parttime or fulltime.
Hi,
I am working in company 'A' on H1B, Green card is processing from company 'B' as future employee. Got EAD.
The job is getting over from Company 'A'.
Can I use my EAD and can stay in US with out working to any company?
Will there be any issues if TAX is not paid when I am not working.
If i work part time then on do I need to work for company 'B' only?
Thanks

Fellas,
Looks like the pundits are saying that the House, and possily Senate, will fall into Democrat hands beginning January.
Here is what Robert Novak says:
The conventional wisdom about the 2006 elections among both Republicans and Democrats now is that the Democrats will take control of the House and could also win the Senate. One House Republican committee chairman, who publicly exudes optimism, privately predicts -- and has predicted for six months -- a loss of 30 House seats.
==
If that's a wisdom, no wonder Democrats are in no mood to compromise on CIR. That also explains the chilly reception to Hutshison-Pence. When the democrats have the house they'll craft a new immigraton package and compromise with the perhaps even more democrat-leaning senate. So 2007 is going to be the year of CIR. If the republicans are smart, they're going to try to get best immigration deal possible in the lameduck session before the 110th Congress starts in January. But the democrats may block it altogether. In that case the retrictionists are going to be sorry they didn't take the best deal when it was available (which look like now).

1. Many of the them are in between 2002 and 2006, so you need to increase the options.
2. What is the purpose and use of this poll?
3. Questions on the poll does not really give any clue
4. Is this something important for you or for all

yes there most likely will be an RFE asking for her paystubs...looking at the current trends. You might try her stamping H-4 instead. People have a higher rate of success there. For her H-4 stamping, they just might ask for your paystubs....but thats also not a complete guarantee.
